Terms of Service

Provider: Ladislav Votroubek, a sole trader under Czech trade law, Company ID (IČO) 88930653, registered office Vršovická 796/37, 101 00 Prague 10, Czech Republic, not registered in the Commercial Register. The service operates under the Munwyn brand. Contact: info@munwyn.com. This English version is provided for convenience; in case of conflict, the Czech version prevails.

1. Introduction

1.1 These terms govern the relationship between the provider identified above ("we") and you when using the Munwyn application available at munwyn.app and in mobile apps (the "service").

1.2 Munwyn is a personal knowledge tool — a "second brain": it captures thoughts as text, voice or images, connects them automatically using AI, and brings them back to you.

1.3 By creating an account you confirm that you have read and agree to these terms. The contract is concluded in Czech; this English version is informational.

1.4 The service is intended for persons aged 15 or older. Persons under 18 need a legal guardian's consent for paid services. By creating an account, starting a paid service or submitting an order you confirm that you meet these conditions — i.e. that you are at least 18, or that you have your guardian's consent. If we learn this is not the case, we may terminate the paid service and refund the payment.

2. Account and registration

2.1 An account is required. Registration may temporarily be limited to invitations or access requests; there is no legal entitlement to an account.

2.2 You must protect your credentials and are responsible for activity under your account, unless it results from our breach of duty.

2.3 The account is personal and non-transferable.

3. Service tiers and prices

3.1 Free — the core tier, free of charge and without time limit: unlimited thoughts and areas, semantic search, the map of thoughts with a 3D atlas preview, and further features as described at munwyn.com. Attachment storage is limited (currently 500 MB; text never counts toward the limit).

3.2 Munwyn Insight — a paid subscription (monthly or yearly): the full 3D atlas, AI syntheses (the Sunday letter, contradiction detection, open loops and more) with an allowance of 100 syntheses per month, 5 GB for attachments, and further features as described.

3.3 Munwyn Direct — a paid subscription where AI syntheses run on your own third-party API key (Anthropic). Syntheses are not subject to a monthly allowance; you bear the API costs directly toward its provider. The key is stored encrypted and you may delete it at any time.

3.4 Founding license — a one-off license limited to 500 units: lifetime access to Munwyn Insight features including the monthly allowance of 100 syntheses. The founding license does not include unlimited AI syntheses. It is sold exclusively at munwyn.com. "Lifetime" means for the lifetime of the service (Section 10).

3.5 Current prices are shown at munwyn.com and in the app, always in the currency of your market. Prices are final; VAT is calculated from your billing country at payment. Price changes never affect an already paid period.

3.6 Every new account automatically receives a 7-day free trial of Munwyn Insight features. The trial requires no payment card; afterwards the account continues on the Free tier — nothing is charged automatically.

4. Payments and renewal

4.1 Payments are processed by Stripe Payments Europe, Ltd. Card details never reach our servers.

4.2 Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel any time in the customer portal available from the app; the subscription then runs until the end of the paid period, after which the account moves to the Free tier.

4.3 Moving to the Free tier never deletes your data — thoughts, areas and attachments remain; only paid-tier features are suspended. Attachments above the Free limit remain stored, but new uploads above the limit are not possible.

4.4 The founding license can be purchased without an existing account by entering an e-mail address. After payment we send an invitation to register to that address, valid for 1 year; the license activates upon registration with that address. Purchasing a license for someone else's address gifts the license to the owner of that address.

4.5 Failed renewal payments may result in the account moving to the Free tier after the paid period plus a reasonable grace period.

5. Right of withdrawal (consumers)

5.1 If you are a consumer, you may withdraw from a paid-service contract within 14 days of its conclusion without giving a reason, by e-mail to info@munwyn.com or using the model form below.

5.2 You acknowledge and expressly request that the paid service starts immediately upon payment, i.e. before the withdrawal period expires. If you withdraw within the period, we refund the amount paid, reduced proportionally by the value of the service provided until withdrawal.

5.3 For the founding license we refund the full amount if you withdraw within the 14-day period and have not yet activated the license by registering; after activation, Section 5.2 applies.

5.4 Refunds are made by the same payment method within 14 days of withdrawal. After the 14-day period the right of withdrawal lapses; your statutory rights regarding defective performance and your rights under Section 10 remain unaffected.

6. Your content and intellectual property

6.1 Content you put into the service (thoughts, attachments, recordings) remains yours. You grant us a license to process it solely to the extent necessary to provide the service (storage, backups, indexing, AI processing according to your settings).

6.2 The service, its code, design and the Munwyn brand are our intellectual property.

6.3 You can export your content and delete your account at any time directly in the app.

7. Artificial intelligence

7.1 Parts of the service use third-party large language models. AI outputs (summaries, insights, letters, challenges) are automatically generated observations, not facts, advice or professional recommendations — they may be inaccurate and it is up to you how you use them.

7.2 You can exclude any individual thought from AI processing ("Keep from AI"); the app provides a log of what has been sent for AI processing. Details in the Privacy Policy.

7.3 On Munwyn Direct you are responsible for using your own API key in accordance with its provider's terms.

8. Acceptable use

8.1 You must not use the service for unlawful activity, to store content infringing third-party rights, to attempt to breach its security, or in a way that unreasonably burdens it (in particular automated bulk requests).

8.2 We apply technical safeguards (e.g. request rate limits) to keep the service stable. In case of serious or repeated breach we may restrict or terminate the account; for paid accounts we refund the proportional part of the prepaid period, unless the breach consisted of intentional abuse of the service.

9. Availability and liability

9.1 We provide the service with professional care but do not guarantee uninterrupted availability. We aim to announce planned maintenance in advance.

9.2 We recommend exporting important content; we perform regular backups, but they do not replace your own backup.

9.3 To the extent permitted by law, our liability for damage is limited to the amount you paid for the service in the preceding 12 months. This limitation does not apply to damage caused intentionally or by gross negligence, nor to consumer rights that cannot be contractually limited.

10. Duration and discontinuation of the service

10.1 We reserve the right to discontinue the service in the future. In that case we will give at least 90 days' notice, enable export of all data, and refund subscribers the proportional part of the price for the unused period.

10.2 The founding license lasts for the lifetime of the service. If the service is discontinued, the holder receives a proportional refund of the license price based on the unused period, the license being deemed fully used up 36 months after activation (example: discontinuation 18 months after activation entitles the holder to half the price; after 36 months or more, no refund is due). Statutory rights regarding defective performance remain unaffected.

11. Changes to these terms

11.1 We may reasonably amend these terms, in particular when the law or the scope of the service changes. We will announce changes by e-mail and in the app at least 14 days in advance. If you disagree, you may terminate the service; for subscriptions the change applies from the next billing period.

12. Dispute resolution

12.1 The relationship is governed by Czech law; mandatory consumer-protection provisions of the country of your habitual residence remain unaffected.

12.2 Consumer disputes may be resolved out of court via the Czech Trade Inspection Authority (coi.cz) or the EU ODR platform (ec.europa.eu/consumers/odr).

12.3 Complaints are handled at info@munwyn.com.

13. Personal data

13.1 Processing of personal data is described in the separate Privacy Policy.

14. Final provisions

14.1 If any provision is invalid, the remaining provisions stay in force. 14.2 These terms are available at munwyn.com and can be saved.
